Privacy Policy

This Privacy Policy Statement (“Privacy Policy”) explains how Aqua Yield Operations, LLC, a Utah limited liability company, BFP Management, LLC, a Utah limited liability company and any affiliates of said entities (collectively the “Company”) uses your information and applies to all who use the Company websites, mobile applications, and other electronic services, including, but not limited to, www.aquayield.com (collectively the “Website”).

We may collect and, in some cases, disclose information about you. By accessing or otherwise using the Website, you agree to the terms and conditions of this Privacy Policy (which is incorporated into and forms a part of our “Terms of Use” Agreement) and consent to the processing of your information according to the Privacy Policy.

INFORMATION WE MAY COLLECT

Information Voluntarily Provided by You. When you voluntarily input information on our Website, submit a separate purchase order for the purchase of a product or service, or participate in any advertised events, we may collect a variety of information that you voluntarily provide, including your name, birth date, email address, phone number, billing information, credit card information and other information you provide. We also may collect other profile data such as your geographical location and proposed use of our products and services, and any content or other communications you provide or make in connection with your use of the Website. We may also obtain information from other sources and combine that with information we collect through our Website.

Information Collected by Our Servers. We may automatically track certain basic information about our members (such as internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, click patterns, etc.). We use this information to do internal research on our members’ usage patterns, demographics, interests and general behavior to better understand and serve you and our community. This is done through the use of data collection devices such as “cookies” on certain pages of the Sites. “Cookies” are small files placed on your hard drive that assist us in providing customized services. The Company cooperates with court ordered inquiries, law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights. We can (and you authorize us to) disclose any information about you to law enforcement and other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with any investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability.

In the event we go through a business transition such as a merger, acquisition by another company or sale of all or a portion of our assets, your personally identifiable information may be among the assets transferred. THIRD PARTIES AND OTHER INFORMATION COLLECTORS

This Privacy Policy only addresses the use and disclosure of information by us through your interaction with the Website. Other websites that may be accessible through links from the Website may have their own privacy statements and personal information collection, use, and disclosure practices. We encourage you to familiarize yourself with the privacy statements provided by these other parties prior to providing them with information.

OPTING OUT

You can opt out of receiving promotional messages from us such as emails, text messages and telephone calls as directed on such communication. If you opt out of our promotional communications, we may still send you non-promotional messages about our ongoing business relations.

We take reasonable measures to help protect your personally identifiable information in an effort to prevent loss, misuse and unauthorized access, disclosure, alteration and destruction. Even though we have taken steps to protect your information, no company, including us, can fully eliminate security risks associated with personally identifiable information.

CALIFORNIA RESIDENTS

If you are a California resident, you may request that we provide to you (i) a list of the categories of personal information about you that we have disclosed to third parties for the third parties’ direct marketing purposes during the calendar year preceding your request, (ii) the names and addresses of such third parties, and (iii) if the nature of the third parties’ business cannot reasonably be determined from their names, examples of the products or services marketed, if known to us, sufficient to give you a reasonable indication of the nature of the third parties’ business. DISPUTE RESOLUTION

Any dispute, claim or controversy arising out of or relating to this Privacy Policy or previous Privacy Policy statements shall be resolved through negotiation, mediation and arbitration as provided under our Terms of Use Agreement.

NOTICE OF CHANGES AND UPDATES TO PRIVACY POLICY

We reserve the right to modify this Privacy Policy from time to time. If we make any changes to this Privacy Policy, we will change the “Last Revision” date above and will post the updated Privacy Policy on this page.
